vKumu's study materials are protected by the laws of copyright of the United States and other countries throughout the world. Unauthorized reproduction of these materials, or portions thereof, in any form whatsoever, is strictly prohibited.
The vKumu content you have purchased are to be used for your own personal use and benefit. Unauthorized commercial resale of Kaplan IT Training materials is prohibited.
Creating, purchasing, and/or using photocopied (i.e., pirated, illicit copies) study notes and other preparatory materials violates the law and may violate Code of Ethics and Standards of Professional Conduct as set forth by the respective accrediting agencies.
Shared use of product is prohibited. You understand that your subscription to any Online Access is a limited license to use the content only for the access period, which is between the time access is granted and the access expiration date. Access periods are either 30, 180, or 365 days. The subscription is non-transferable and is to be used only by you. You will not share the username/user id and password with anyone, even if that person has his or her own subscription to Online Access. Such sharing of usernames/user ids and passwords is a violation of this Agreement and will result in immediate suspension of your privileges to any Online Access at vkumu.com, exams.vkumu.com, or lms.vkumu.com without refund. vKumu will only support (as it sees fit) subscriptions purchased through our website. “vKumu” and its products are trademarks of vKumu, LLC. Other marks which appear on this website may be marks of third parties that are not affiliated with vKumu.
Please read this Agreement carefully before accessing or using your Online Access. By accessing or using online products or services, you agree to be bound by the terms and conditions set forth herein. If you do not wish to be bound by these terms and conditions, you may not access or use your Online Account. vKumu may modify this Agreement at any time and such modifications shall be effective immediately upon posting of the modified Agreement. You agree to review the Agreement periodically to be aware of such modifications and your continued access or use of Online Access shall be deemed your conclusive acceptance of the modified Agreement.
Service Agreement
vKumu will to the best of its ability provide uniterrupted access to its platforms found at exams.vkumu.com and lms.vkumu.com. However, vKumu is not responsible for any period of service interuption to include scheduled maintenance or any unscheduled outage. By purchasing any subscription from vKumu, you understand that your service to vKumu may be interrupted at anytime without entitlement to a refund.
Indemnification
You agree to indemnify, defend, and hold harmless vKumu; vKumu, LLC and their respective subsidiaries, officers, directors, employees, agents, licensors, suppliers, and any third party information providers to vKumu’s Online Access from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by you.
Miscellaneous
This Agreement shall be governed and construed in accordance with the laws of the State of Texas applicable to agreements made and to be performed in Texas. You agree that any legal action or proceeding between vKumu and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Texas. Any cause of action or claim you may have with respect to vKumu’s Online Access must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. vKumu’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. vKumu Training may assign its rights and duties under this Agreement to any party at any time without notice to you.
